Terms of Service

These Terms of Service ("Terms") govern your use of the Prepxa mobile application and website (collectively, the "Service"), provided by Nexzt Entrepreneur Consultancy PVT LTD ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

You must be at least 13 years of age or the legal age of majority in your jurisdiction to use the Service. By accessing or using the Service, you represent that you meet these age requirements. If you do not agree to these Terms, you may not use the Service.

2. User Accounts and Authentication

• Account Creation: Accounts are created using your mobile phone number and secured via a One-Time Password (OTP) sent through a third-party service (MessageCentral).
• Accuracy: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• Security: You are responsible for maintaining the confidentiality of your account access and are fully responsible for all activities that occur under your account.

3. Intellectual Property and AI-Generated Content

• Proprietary Content: The Service, including its design, text, graphics, and the underlying AI algorithms (Vertex AI Engine), is the property of Nexzt Entrepreneur Consultancy PVT LTD and is protected by intellectual property laws.
• License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial educational use.
• AI Question Bank: The questions generated by our AI are for educational practice only. You may not reproduce, redistribute, sell, or commercially exploit any questions or content generated by the Service. Any attempt to systematically scrape or download the content constitutes a severe breach of these Terms.

4. Wallet, Pricing, and Refunds (Crucial Section)

• Wallet System: Access to Custom Tests and Full Mock Tests is managed via a non-transferable internal currency ("Wallet Balance" or "Credits").
• Payment: Wallet recharge transactions are processed via third-party payment gateways (e.g., PhonePe). We do not store your sensitive financial details.
• Finality of Recharges: All wallet recharges are considered FINAL. Once funds are added to your Prepxa Wallet, they are NON-REFUNDABLE and cannot be converted back to cash or transferred to another account.
• Test Fees: The fee for each test (e.g., 5 or 9 credits) will be deducted from your Wallet Balance upon confirmation of test creation.
• Test Generation Failure: In the rare event that the AI fails to generate your test (status: 'error'), the full cost of the test will be automatically refunded to your Wallet Balance.

5. Prohibited Conduct

You agree not to misuse the Service or assist others in doing so. Prohibited conduct includes:

• Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
• Attempting to probe, scan, or test the vulnerability of any system or network or breaching any security or authentication measures.
• Introducing viruses, bots, or other destructive code.
• Engaging in any commercial activity, including reselling the Service or its content.

6. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. Sections 3, 4 (Refunds), 7, and 8 shall survive any termination.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in [New Delhi, India] to resolve any legal matter arising from these Terms.
